This Privacy Policy sets out the privacy and data protection principles we follow globally regarding any personal data you may provide to us or we may collect and process related to the CleanSpace services including any website such as www.our.clean.space and the CleanSpace member portal, any software such as the CleanSpace Apps, and the CleanSpace Tag (together the ‘CleanSpace Services‘). By ‘personal data‘ we mean any data that personally identifies you, from which you could be identified, or which could identify you in conjunction with other data. We use it interchangeably with the US term `personally identifiable information‘. This policy contains important information about your rights. We hope you read this privacy policy carefully so you understand and feel comfortable with how we treat your personal data. By engaging with us in the ways set out in this Policy, you confirm that you have read and understood the entirety of this Policy as it applies to you.

Your use of the CleanSpace Services is your consent to our use of your personal data (and other data you provide to us) in accordance with this policy, including (if you are a resident of the European Economic Area (‘EEA’)) the transfer of your personal data outside the EEA.

We may change this Privacy Policy from time to time and will post any change on our website, with a more prominent notice where the change is significant. Your continued use of the CleanSpace Services is your agreement to the updated Privacy Policy.

Please note, this Privacy Policy does not apply to any of our other services which may have separate privacy policies, or any service offered by a third party, which will be subject to the privacy policy of that third party.

Your rights to object: You have various rights in respect of our use of your personal data as set out in section 17. Two of the fundamental rights to be aware of are that you may:

a) ask us to stop using your personal data for direct-marketing purposes. If you exercise this right, we will stop using your personal information for this purpose.

b) ask us to consider any valid objections which you have to our use of your personal data where we process your personal information on the basis of our, or another person’s, legitimate interest.

1. Who ‘we’ are

CLEANSPACE is the trade mark of Drayson Technologies (Europe) Limited of Grand Union Studios, 332 Ladbroke Grove, London W10 5AD (`Drayson UK’), and a trading name of Drayson UK, Drayson Technologies Inc, of 19200, Stevens Creek boulevard, Ste 200 Cupertino, CA 95014, United States (`Drayson USA’) and Drayson Technologies Mexico, S.A. de C.V. of Varsovia 36, Col. Juarez, Mexico City, ZIP 06600 (`Drayson Mexico’), together the `Drayson Group’. ‘We’, ‘us’ and ‘our’ refers to one or more or all of the Drayson Group as the context requires. Each member of the Drayson Group agrees to protect and process personal data related to the CleanSpace Services in accordance with this Privacy Policy and applicable data protection laws.

2. Data we collect

We generally collect Account Data and Service Data in ways described below, although you may provide data to us otherwise and we may be given data by a third party, for example in a ‘refer a friend’ program or through the Third Party Program outlined in section 6 below] When we collect data we will provide you with a ‘data collection notice’ stating the purpose for collecting it and linking to this Privacy Policy. We need the personal data that we collect so that we can provide the CleanSpace Services to you. If you don’t provide us with that information you may not be able to access certain CleanSpace Services.

  • Account Data’ – when you sign-up to the CleanSpace Services, or to any later promotion or activity in the CleanSpace Services, we collect the following personal details in order to establish and manage your account:
    • your name;
    • age range;
    • gender;
    • email address.
  • Service Data’ – when you use the CleanSpace Services, we may collect the following data through your use of the CleanSpace Services or otherwise:
    • data about your devices such as your smartphone including the model, operating system version, browser, IP address and unique device identifiers;
    • if you have enabled location tracking, then data about your location, journey, mode and distance of travel;
    • if you have ordered a Tag, then the shipping address, geo-located and non-geo-located data about air quality.

When you provide us with personal data about yourself or another person, you are confirming to us that you are authorised to provide us with that information and that any personal data you give us is accurate and up-to-date.

Location Data – please note you can prevent tracking, and collection of location data, by the CleanSpace App by switching the location tracking mode of your phone to ‘off; location data is only collected when the location tracking mode of your phone is ‘on’. By switching the location tracking mode to ‘on’ you are consenting to our collection of location data for processing according to this Privacy Policy.

We do not need or ask for ‘sensitive personal data‘ to provide the CleanSpace Services and ask that you do not provide it to us. ‘Sensitive personal data’ (also known as special categories of personal data) includes data revealing racial origin, political opinions or religious or philosophical beliefs, trade-union membership and data concerning health or sex life.

If you are accessing the CleanSpace Services in the EEA, then applicable law requires us to ensure that we only process your personal data where we have a legal basis to do so. When we process your personal data we will only do so where at least one of the following applies:

    1. If it is in our legitimate interests to use your personal data and this is set out in section 4 of this Privacy Policy. For example, it is in our legitimate interests to use your personal data to improve the CleanSpace Services, and to share your personal data with third parties who provide services to us relating to the CleanSpace Services. If you would like further information about how we decide when a particular use is in our legitimate interests, you may contact us using the contact details set out in section 18;
    2. We need to use your personal data to perform our responsibilities under a contract we have with you (including for example, making our CleanSpace Services available to you in accordance with our terms of use);
    3. Sometimes we may ask for, or rely on, your consent to use certain types of personal data (e.g. by asking you to tick an online box or by only using location data where you have consented to that processing). In these circumstances, your consent will be our legal basis for processing your personal data. If you have provided consent, you may withdraw it at any time. You may do this by “opting out” where we give you the opportunity to do so, by contacting us using the contact details above or, in respect of location data, by switching the location tracking mode of your device to ‘off’;

4. Using data

We will use your data for the purposes stated in the data collection notice and in the normal, legitimate, course of our business, including the following required purposes:

  • to confirm that you are eligible to be a member of the CleanSpace community and use the CleanSpace Services;
  • to deliver the CleanSpace Services including to show you details of your exposure to air pollution and recommend journeys that minimise your exposure to pollution;
  • to contact you about your account, including your use of the CleanSpace Services and the balance of your CleanMiles;
  • to ensure that the CleanSpace Services are functioning correctly, including that the CleanSpace App functions correctly on your device and with the CleanSpace Tag, and to monitor, investigate any bug with, and improve the CleanSpace Services;
  • to inform you about any of our products or services which are similar or connected to the CleanSpace Services.

5. Sharing data

We do not sell, rent or lease your personal data to third parties. We shall only share personal data in the limited circumstances below:

  • you may choose to share details about your account or use of the CleanSpace Services, for example the number of CleanMiles or rewards you have earned so that you can compete or judge your performance against other CleanSpace users, or you may post information from the CleanSpace Services to social media, and if you do, we will enable sharing;
  • to the extent required or authorized by law including to comply with a legal obligation such as a court order or binding decision of a legally competent authority, to protect or enforce our legal rights, or to protect the health or life of an individual;
  • if we undertake a transaction, or preparations for a transaction, such as a business sale, we may share the personal data to the extent required with the other party to the transaction and only after ensuring that the recipient has appropriate security and confidentiality measures in place to protect the personal data; or
  • we will not share your personal data with other companies or organisations, for them to use the data to market and promote their own products and services to you, without your prior consent.

6. Third Party Program

Where you obtain the CleanSpace Services, including a CleanSpace Tag, under a program carried out with a third party such as your employer, university or a charity, we may share data related to your use of the CleanSpace Services under that program with that third party and you acknowledge that they might be able to identify you from the data we do share with them in conjunction with other data they may hold about you. If you do not consent or withdraw your consent to the above, simply cease using the CleanSpace Services as a participant in that program.

7. Transfer of personal data outside of the EEA

Your personal data may be used, stored and/or accessed by staff operating outside the EEA working for us, other members of our group or suppliers.

If we provide any personal data about you to any such non-EEA members of our group or suppliers, we will take appropriate measures to ensure that the recipient protects your personal data adequately in accordance with this privacy policy. These measures may include the following permitted in Articles 45 and 46 of the General Data Protection Regulation:

    1. in the case of US based entities, entering into European Commission approved standard contractual arrangements with them, or ensuring they have signed up to the EU-US Privacy Shield (see further https://www.privacyshield.gov/welcome); or
    2. in the case of entities based in other countries outside the EEA, entering into European Commission approved standard contractual arrangements with them.

8. How long we store your personal data

We keep your personal data for no longer than necessary for the purposes for which the personal data is processed. The length of time we retain personal data for depends on the purposes for which we collect and use it and/or as required to comply with applicable laws and to establish, exercise or defend our legal rights.

9. Children

We do not and will not knowingly collect information from any unsupervised child under the age of 13. If you are under the age of 13, you may not use the CleanSpace Services unless your parent or guardian has provided us with their consent for your use of the CleanSpace Services. Please contact us using the contact details at section 18 if you are aware that we may have inadvertently collected personal data from a child.

10. Testimonials

If you make a positive, public remark about the CleanSpace Services, for example on social media, you agree that we may use that remark as a testimonial.

11. Non-personal or anonymized data

Data generated from use of the CleanSpace Services that is no longer necessary and relevant may be de-associated with your name and other identifiers and aggregated with other data to provide insights which are commercially valuable to us. For example, we will aggregate geo-located pollution readings from Tags to create a map of air pollution from which it is not possible to identify a living individual. We will also use that de-identified and aggregated data, for example, to show trends in air pollution or trends in the use of the CleanSpace Services, or to create a consolidated air pollution map of an area or location. We may share such de-identified and aggregated data publicly or with third-parties such as publishers and commercial or research partners.

12. Security

We shall use appropriate technical and organizational measures to protect personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access.

13. Cookies

We will use cookies and data collection tools when you browse our website(s) or otherwise use the CleanSpace Services. Accepting the cookies will give us access to information about your browsing behaviour which we will use to deliver, personalise or improve your experience, our marketing and our services. Most browsers and devices automatically accept cookies and data collection tools by default but you can usually refuse or selectively accept cookies and data collection tools by adjusting the preferences in your browser or in your device settings.

The CleanSpace Services may contain hyperlinks to websites that are not operated by us. These hyperlinks are provided for your reference and convenience only and do not imply any endorsement of the activities of such third-party websites or any association with their operators. This privacy policy only applies to the personal information that we collect or which we receive from third party sources, and we cannot be responsible for personal information about you that is collected and stored by third parties. Third party websites have their own terms and conditions and privacy policies, and you should read these carefully before you submit any personal information to these websites. We do not endorse or otherwise accept any responsibility or liability for the content of such third party websites or third party terms and conditions or policies.

15. California Privacy Policy

Please note that our websites do not respond to ‘Do-Not-Track’ signals communicated by your internet browser. (As above, please note you can prevent tracking, and collection of location data, by the CleanSpace App by switching the location tracking mode of your phone to ‘off’.)

16. Updates to this Privacy Policy

We may change this Privacy Policy from time to time and will post any change on our website, with a more prominent notice where the change is significant.

17. Your rights

If you are in the European Economic Area (“EEA”) you have certain rights in relation to your personal data. If you would like further information in relation to these or would like to exercise them, please contact us using the contact details in section 18 below at any time. You have the right to request that we:

  • provide access to any personal data we hold about you;
  • update any of your personal data which is out of date or incorrect;
  • delete any personal data which we are holding about you;
  • restrict the way that we process your personal data;
  • prevent the processing of your personal data for direct-marketing purposes
  • provide your personal data to a third party provider of services;
  • provide you with a copy of any personal data which we hold about you; or
  • consider any valid objections which you have to our use of your personal data.

We’ll ask you to prove your identity when you make such a request. We will respond to your request and effect any change as soon as reasonably possible and in any event, in accordance with any local legal requirement. Please note, however, that certain personal data may be exempt from such requests in certain circumstances, for example if we need to keep using the information to comply with our own legal obligations or to establish, exercise or defend legal claims. If an exception applies, we will tell you this when responding to your request.

In accordance with Article 77 of the General Data Protection Regulation, you may also make a complaint to the Information Commissioner’s Office (its contact us page is available here), or the data protection regulator in the country where you usually live or work, or where an alleged infringement of the General Data Protection Regulation has taken place. Alternatively, you may seek a remedy through the courts if you believe your rights have been breached.

Datos que recopilamos

De forma periódica recopilamos los Datos de la Cuenta y los Datos del Servicio en las formas que se describen enseguida. Sin embargo, usted puede proporcionarnos datos de otra forma y es posible que algunos terceros nos proporcionen datos, por ejemplo, en un programa de “recomiende a un amigo”. ‘Datos del Servicio’: cuando usted hace uso de los Servicios de CleanSpace, podemos recolectar la siguiente infornnaciOn mediante el uso de los Servicios de CleanSpace o de otra forma: la informaciOn acerca de su dispositivo tal como el modelo de hardware, la version del sistema operativo, la navegaciOn, la direcciOn IP y los identificadores de dispositivos Cmicos; si usted ha habilitado el rastreo, entonces los datos acerca de su ubicaciOn, ruta y el modo y la distancia del recorrido; datos que comparta con nosotros en caso de que nos otorgue el permiso de vincular un servicio tal y como la es “HealthKit” o “Google Fit”; y, si usted cuenta con Tag, datos geo-localizables y no geo-localizables acerca de la calidad del aire.

Cuando nos proporciona datos personates acerca de usted o de otra persona, usted ratifica que esta autorizado para proporcionarnos dicha infornnaciOn y que cualquier dato personal que nos suministre es exacto y actual.

Datos de LocalizaciOn: considere que puede evitar el rastreo y la recolecciOn de datos de localizacion a traves de la CleanSpace App al cambiar el modo de localizaciOn o rastreo de su telefono a “apagado”; los datos de localizaciOn solo se recolectan cuando el modo de localizaciOn o rastreo de su telefono este en “encendido”. Al cambiar el modo de localizaciOn o rastreo a “encendido” consiente la recoleccion que llevamos a cabo de los datos de localizacion para procesarlos de conformidad con esta Politica de Privacidad.

No requerimos o solicitamos “datos personales sensibles” para proporcionar los Servicios de CleanSpace y le solicitamos que no nos los proporcione. Los `datos personales sensibles’ incluyen la divulgaciOn de datos tales como el origen racial, las opiniones politicas o religiosas o las creencias filosOficas, la afiliaciOn sindical y los datos referentes a su salud o vida sexual.

Uso de datos

Podemos hacer uso de sus datos para los fines establecidos en el aviso de recolección de datos, y en el curso normal y legítimo de nuestro negocio, incluyendo los siguientes fines necesarios:

  • para confirmar que es candidato para ser miembro de la comunidad de CleanSpace y usar los Servicios de CleanSpace;

Programa de Terceros

Cuando adquiera los Servicios de CleanSpace, lo que incluye el CleanSpace Tag, conforme a un programa a cargo de un tercero tal como su patrón, la universidad o una institución benéfica, usted está de acuerdo en que podremos compartir datos no personales o anónimos relacionados con el uso de los Servicios de CleanSpace conforme al programa con el tercero y reconoce que, aunque no compartiremos ninguno de sus datos personales con dicho tercero, ellos podrían identificarle con motivo de los datos que compartimos con ellos, en conjunto con otros datos que ellos tengan acerca de usted. Si usted hace algún comentario positivo y público acerca de los Servicios de CleanSpace, por ejemplo, redes sociales, usted está de acuerdo en que podemos usar esos comentarios como testimonio

Datos no personales o anónimos

Por datos no personales o anónimos nos referimos a datos generados del uso de los Servicios de CleanSpace combinados o que de alguna otra forma son anónimos, por lo que ya no son datos personales. Por ejemplo, podemos agregar las lecturas de contaminación geo-localizadas de Tags para crear un mapa de la contaminación del aire, lo que no permite la identificación de un individuo derivado de los datos. Seguridad
